Our Imperial Judiciary
This dangerous 10 year old criminal who attempted to take a glass of water
into the Woodside Hospice for the brain-damaged woman being starved to
death at the direction of a federal judge is taken down by these heroic “Men in Blue.”

Concerning the Bible it has been correctly said that:
“The Gospel of Jesus Christ is so simple that to misunderstand it you
must have the help of a religious scholar (Preacher, Priest, or Rabbi).”
Unfortunately, the same is true of our great Constitution.
In order to misunderstand or misapply it you must have the
help of a constitutional scholar (Teacher, Lawyer, or Judge).
The preamble to our great Constitution clearly states that :
“We the People of the United States….do ordain and establish
this Constitution for the United States of America.”
Our founding fathers envisioned a democratic government “of the people, by the people and for the people.” They understood that in a truly free society the people themselves have the right to determine just what type of society they wanted to live in.
To accomplish this they designed a system of checks and balances under which We the People would make the laws which we deem necessary to protect the way of life we wish to enjoy and the type of society in which we wish to live.
The first basis upon which that system was built was a system of majority rule. Our founders understood that there would always be minorities who would object to the morals and desires of the majority, but they also understood that, while the rights of the minority must be protected, they could not allow a dissenting minority to dictate the rights of the majority.
To accomplish this they ordained a system of “one man-one vote.” With every vote being equal We the People of America, through the ballot box, would determine exactly what system of values we want to be the law of the land.
To accomplish this this great ideal, they divided the government into three separate but equal branches.
The first branch would be the Legislative Branch, our United States Congress. This branch of the government would make the laws under which We the People would live. To insure that the legislative branch of the government would truly represent the will of We the People they required them to periodically stand for reelection by We the People. The House of Representatives must stand for reelection every two years while the Senators must stand for reelection every six years. Any congressman who did not support the will of his constituency would be subject to replacement by the will of We the People.
By determining who would be our representative, via the ballot box, We the People would retain control over our government and could force it to abide by the collective will of We the People. This system of government was so unique and so ingenious that it testified to the inspired genius of our founders.
Realizing that the laws passed by the people, through their elected representatives, must be enforced, they determined that an executive branch of government would be established which was specifically designed to enforce the laws enacted by the representatives of We the People. That branch is comprised of the President and his cabinet. To insure that he also carries out the will of We the People he was required to stand for reelection, by We the People, every four years, Later, in order to prevent the possibility of an “imperial Presidency,” an amendment was passed that limited his term of service to eight years, or two four year terms.
The third of the three branches of government was to be the judicial branch, or our federal court system The purpose of this branch was to protect the people and their rights by insuring that no laws were passed which violated the terms of our great Constitution. All laws enacted by the legislative branch of the government must confirm to the requirements of our Constitution. It was the purpose of the judicial branch to enforce the Constitution, not to interpret it. In order to ensure a independent, impartial and objective judiciary these individuals would be appointed for life Thus it was intended by our founders that they would be above politics and out of the reach of special interest groups.
To insure that the judiciary was truly independent and answerable only to the people, two restriction were placed on the appointment of judges. In order to become a federal judge a person must be appointed by the President (who was elected by and accountable to the people) and confirmed by a majority of the Senate (who was also elected by and accountable to the people.)
This great system and noble cause of checks and balances was intended to always support and protect the will and rights of We the People. Unfortunately, the will of We the People has now been usurped by an “Imperial Judiciary” that was never intended by our founders.
Two things have made this usurpation of power possible. The Senate has determined that a majority of 60% of the senators is necessary to approve the appointment of an individual to the judiciary branch rather than the 51% required by our Constitution and the federal judiciary has claimed for itself the right to “interpret the Constitution” rather than just “enforce it” as directed by our founders
By allowing a minority of our Senators to determine who will be appointed to the judiciary and by allowing those approved by a minority of the Senate to “interpret rather than enforce” the Constitution we now have a system of government of the minority rather than a government of the majority as envisioned by our founders.
Our Constitution states very clearly that the rights of the government are only those granted by We the People and all other rights are reserved to We the People
Our land is now being ruled by, not by We the People as envisioned by our founders, but by an Imperial Judiciary that has put itself beyond the reach of We the People.
This problem can and must be corrected and it is We the People who must correct it. We the People must:
1. Let our Senators know that they must drop the filibuster against federal judicial appointments or be defeated in the next election. Their thirst for power will force them to bow to the will of their constituents if they truly believe their reelection is at stake.
2. Force campaign finance reform to insure that each representative is accountable to the people who they have been elected to represent and not to some special interest group. This can be done by insisting that:
A. Only individuals can contribute to the campaign of a candidate, and
B. Only the people who are qualified to vote for a candidate are allowed to give money to the campaign of that candidate.
These simple rule changes will have a domino effect on our entire system of government.
The President will be a person elected by and accountable to only the will of We the People. Every Representative and senator will be accountable to the people they represent, only those people, and subject to the approval of those people. If we make this eminently clear to the politicians they will listen to We the People in both the appoint and the approval of judges, which in turn will make our judicial system also accountable to We the People thereby making our society once again the kind of society desired by We the People, not that advocated by special interest groups.
Most of us who are senior citizens will not live to see the fruits of our labor but our children and grandchildren will live in a better society because of the efforts of We the People This is the great legacy which this generation can leave to our posterity. We can do nothing greater, and they deserve nothing less.
